Canada Revenue Agency (CRA)'s guide RC4110 explains the difference between an employee and a subcontractor.  It is important that you understand which the government is likely to assess you or your worker as.  It affects your income tax deductions, whether you are the employer or the employee/subcontractor.   The company for whom the worker is working will likely prefer to call the worker a Subcontractor, so they can save the expenses of:  CPP, EI, WCB premiums, vacation pay, some insurance premiums, other overhead costs and remove their duties regarding continuous employment as an employer.

The following chart used to be a part of the CRA guide RC4110.  They removed it.  I am reprinting it here for your use.  Please print it and fill in the answers.  Use it to see how CRA might decide in your particular case.

To the employer:  If a CRA audit takes place and they determine the worker was an employee, they can charge your company for the unpaid CPP and EI premiums which you owe as the employer and also for the employee's share.  It can be a very expensive proposition.  You might also have a nasty surprise if a Labour Board decision says you owe that person for vacation  pay, statutory holiday pay and pay in lieu of notice of termination.   Please be very careful.  The auditors tell me the SINGLE MOST IMPORTANT FACTOR that they go by is this:  "Who is providing the equipment?"
